General Terms and Conditions (GTC) for participation in training courses

Participant = Company or private individual registered for the workshop

 

1 Scope of application

These General Terms and Conditions (GTC) govern the contractual relationship between Jens Refflinghaus Processfuse Consulting (hereinafter referred to as “Organizer”) and the participants in training courses, seminars and advanced training (hereinafter referred to as “Training Courses”).

 

2 Registration and conclusion of contract

Registration for a training course shall be made in writing (by e-mail or online form). Registration constitutes a binding offer. The contract is concluded as soon as the organizer has confirmed the registration in writing.

 

3 Services

The organizer offers training courses according to the published program. The scope of the services is based on the information in the training program. The organizer reserves the right to make changes to the course and content of the training, provided that the overall character of the training is maintained.

 

4 Participation fee and terms of payment

The participation fee is due upon registration. The fee includes the services described in the training advertisement. Payments must be made by the date stated on the invoice at the latest. In the event of late payment, the organizer reserves the right to refuse participation.

 

5 Withdrawal and cancellation

Participants may withdraw from the registration in writing up to 14 days before the start of the training course. In this case, a processing fee of 25% of the participation fee will be charged. In the event of later withdrawal or non-attendance, the full participation fee is due. A transfer of participation to another person is possible, provided the organizer agrees in writing.

 

6 Cancellation and changes by the organizer

The organizer reserves the right to cancel the training course for important reasons (e.g. illness of the instructor or insufficient number of participants). In this case, the participation fee already paid will be refunded in full. Further claims, in particular claims for damages, are excluded. The organizer is entitled to change the location and/or time of the course or to change the instructor if this is reasonable.

 

7 Liability

The organizer is only liable in cases of intent or gross negligence. In the event of slight negligence, the organizer shall only be liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. The organizer shall be liable without limitation for damages resulting from injury to life, body or health.

 

8 Data protection

The organizer collects, stores and processes personal data of the participants exclusively for the processing of the training events and in accordance with the provisions of the General Data Protection Regulation (GDPR). Participants agree to the storage of their data. Data will not be passed on to third parties unless this is necessary to carry out the training.

 

9 Copyright

The materials provided as part of the training are protected by copyright. They may not be reproduced or passed on to third parties without the written consent of the organizer.

 

10 Rules of conduct and exclusion

Participants undertake not to disrupt the training and to follow the instructions of the training staff. The organizer reserves the right to exclude participants from the training course who repeatedly violate the rules of conduct. In this case, there is no entitlement to a refund of the participation fee.

11 Final provisions

Amendments or additions to the contract must be made in writing. Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The law of the Federal Republic of Germany shall apply. 

The place of jurisdiction is Dortmund.
